TERMS OF SALE MATISSE JEWELS
ARTICLE 1 / PURPOSE AND IDENTIFICATION
These General Conditions of Sale regulate the sale of products through the website https://www.matissejewels.it.
The products offered are sold by 925 Forever Sas di Maria Laura Testi whose commercial name is MATISSE JEWELS with headquarters in Arezzo (IT) Loc. La Chianicella, 2 - 52100 - registered with VAT number IT02315550513 - Email: firstname.lastname@example.org (hereinafter the "Seller").
The sale is aimed exclusively at anyone who places an order for purposes unrelated to any business, commercial, artisanal or professional activity carried out, over 18 years of age or, if minor, authorized by its legal representative (hereinafter the "Customer" or "Consumer "). Those who work for commercial purposes are invited to refrain from concluding commercial transactions on www.matissejewels.it.
The Customer is required to carefully read the General Conditions of Sale that have been made available on the site.
These Conditions of Sale do not regulate the supply of services or the sale of products by subjects other than the Seller who are present on the site http://matissejewels.it through links, banners or other hypertext links, of which the Seller does not can be held responsible.
ARTICLE 2 / ORDER
These Conditions of Sale constitute the purchase and sale agreement for any product purchased through the site http://www.matissejewels.it and are considered fully and irrevocably accepted by the Customer at the time of submitting each order.
The Order will be considered accepted by the Seller and, therefore, the Purchase Agreement concluded, when the Customer will receive acceptance of the Order in his email box via the email in preparation for the same .
We reserve the right to change these Terms of Sale. Any new Conditions of Sale will be effective from the moment they are published on our Site and will be applied to all Orders submitted from that moment, while for Orders already submitted the previous Conditions of Sale will apply.
ARTICLE 3 / PRODUCTS / PRODUCT AVAILABILITY
Any order implies acceptance of the prices and descriptions of the products available for sale. The Seller undertakes to fulfill the orders received on the site only within the limits of the available stocks of products. In the absence of availability of one or more ordered products, in the event of a failure to promptly update the site, the Seller undertakes to promptly communicate it to the Customer. The missing item in the customer order will be automatically canceled and refunded. The essential characteristics of the products are presented on the Site within each product sheet. However, the images and colors of the products offered for sale on www.matissejewels.it may not correspond to the real ones due to the effect of the Internet browser and the monitor used.
On www.matissejewels.it only new products are offered for sale. The Seller does not sell used products, irregular or of inferior quality to the corresponding standards offered on the market through the traditional sales network.
The 925 Silver products published on the website www.matissejewels.it are marked and stamped "925" which indicates a guaranteed composition of 925 minimum parts of silver and maximum 75 of any other metal. These products are safe and nickel-free in compliance with current regulations.

ARTICLE 4 / PRICES AND INVOICES
All product prices are expressed in euros and indicated with VAT and taxes included (unless otherwise indicated), excluding shipping. Therefore, the delivery costs shown separately in the cart must be added to the prices of the products.
The Seller reserves the right to change prices at any time, at its discretion, without notice to the Customer. The products will be invoiced on the basis of the price in force at the time of order confirmation and remain the property of the Seller until receipt of the full payment. Third countries are subject to VAT and specific duties. Note that the Seller has no control over the specific costs of third countries and it is up to the buyer to contact the local customs office for further information. Any customs fees or duties are not included and are charged to the customer.
ARTICLE 5 / DELIVERY
The Seller processes orders from Monday to Friday (excluding holidays), with an average delay of 48 hours. In some moments (especially during sales, Christmas, private sales), the processing time may be longer due to the greater number of orders to be processed. In addition to this delay there is the time of transport and delivery of orders, provided by different delivery services according to the country. The maximum delivery period, including transport, is 15 working days from the order confirmation date, unless expressly specified. In all cases, the customer automatically receives an e-mail informing him of the shipment and the status of his order. The Seller will do everything in his power to deliver the order to the delivery address, within the expected delivery time. The buyer is responsible for the correct insertion of the delivery address. In the event of problems during the shipment of an order, following an error in delivery (error attributable to the buyer), the Seller cannot be held responsible for the loss of the shipment.
ARTICLE 6 / SHIPPING
Shipping times in Italy are 24/48 hours on working days. The actual transport time depends on the geographical area of destination of the Order. Unless otherwise indicated, the Seller does not offer free shipping to any of the destinations that can be selected when ordering.
For the delivery of the Products, the presence of the Customer or his representative at the recipient's address (indicated in the Order) is required. Upon receipt of the Products, the Customer must verify:
1) that the number of packages delivered corresponds to what is indicated in the consignment note accompanying the goods;
2) that the packaging is intact, not damaged, nor wet or in any way altered, even in the sealing materials.
Any damage to the packaging and / or the Product or the mismatch in the number of packages or indications must be immediately contested in writing on the Courier's proof of delivery. At this point, the Customer must check the quantitative and qualitative correspondence of the Products with what is indicated in the transport document together with the Courier who delivered the package.
Once the courier's document has been signed without the customer making any objection, the customer will not be able to make any objection regarding the external characteristics of the package delivered.
If there is no presence of the Customer or his representative at the address of the recipient indicated in the Order, the courier will make another delivery attempt on the next working day. After the 2nd notice, in case of failure to resolve the inventory positively, the goods will be returned to the Seller. The risk and the charge of any expense are entirely part of the Customer.
In fact, for the payment of the return, the Seller will withhold from the refund an amount equal to the cost incurred for the shipment and delivery (and any other storage costs) of the products to the Customer's home and return to the Seller's headquarters.
ARTICLE 7 / PAYMENT AND SECURITY
Payment for purchases will be made using a credit card (Bankcard, Visa, Mastercard) via PayPal and My Pos or by cash on delivery or bank transfer in advance. The order will be registered after the payment has been accepted by the secure payment service.
The customer must enter the type of card, the name on the card, the card number, expiry date and the security code on the back of the card, in the places provided for this purpose.
Payment to the customer's bank account will be debited when ordering.
The Seller implements all means to guarantee the confidentiality and security of the data transmitted through the web and on the site www.matissejewels.it as such, the site uses a form that provides the encryption of the bank data of the customer's credit card, using SSL (Secure Socket Layer). Contact information will never be transmitted unencrypted over the network.
ARTICLE 8 / WARRANTY AND REPAIR
The warranty covers manufacturing defects that concern the same as the product purchased. The warranty covers all products purchased from our site. Defects caused by wear, visible on the product or on the accessory, must be considered as normal consequences of use.
The warranty does not apply:
- on damages resulting from improper use;
- on damage caused intentionally;
- on the normal wear and aging of the materials used (some examples discoloration of the plating or the color of the jewel).
- in case of negligence, neglect in the use and maintenance of the product, of any adaptations and / or mechanical adjustments not prescribed by the manufacturer etc ...
The lack of conformity must be reported within 24 months following the purchase date; the time period within which the defect of the product must be communicated from the moment it occurred is 2 months.
In the event of a lack of conformity, the consumer has the right to restore the conformity of the goods by repair or replacement.
The guarantee is personal and will therefore apply only to the original purchaser, being reserved for direct customers and not for traders and retailers.
To request a replacement or repair under warranty, use the Contact us area on the website or by email at email@example.com. Provide a valid email, a detailed description and a photo of the problem.
Subsequently, the Seller will evaluate the defects and non-conformities reported by the Customer and decide whether to authorize the return of the Products by providing the Customer with an e-mail response.
ARTICLE 9 / Return Terms
RETURN WITH FREE EXCHANGE - As regards returns with exchange of purchased items, a return request must be made and only after approval by the Seller must the parcel be delivered to a post office, attaching the consignment note for shipping. found inside the package / box. Obviously the product must be intact, not worn and accompanied by its packaging; otherwise the return will not be accepted. The exchange service is free. The costs and the risk of transport remain the responsibility of the customer. The return request with free exchange must be made no later than 14 days.
RETURN WITH FREE RIGHT OF WITHDRAWAL - The right of withdrawal can be exercised from the moment of the conclusion of the contract up to 14 days after the receipt of the goods (Article 65 of the Consumer Code). Clearly, the customer will be released and will be entitled to the refund of the amount paid to the seller, net of delivery and reshipment costs (always paid by the customer), only after verification of integrity and perfect correspondence to what was initially sold. A return request must be made and only after approval by the Seller must the parcel be delivered to a post office, attaching the consignment note in the package / box for shipping. The refund will be made free of charge, in the shortest possible time and in any case within 30 days from the date on which the seller became aware of the customer's exercise of the right of withdrawal. The sums are meant to be reimbursed within the deadlines, if they are actually returned, sent or re-credited in a currency not later than the expiry of the previously indicated deadline.
The right of withdrawal is however excluded in the case of the purchase of tailor-made or personalized goods.
In case of return of products that are not intact, deteriorated or without original accessories or equipment, you will not be entitled to a refund of the amounts already paid to the Seller; however, you can get back, at your expense, the products in the state in which they were returned to the Seller. Otherwise, the Seller may retain the products, in addition to the amounts already paid for their purchase.
If the shipments made by the Customer during the return phase were freight collect, they will not be accepted by the Seller and therefore will be returned to the Customer, with costs to be paid entirely by him.

ARTICLE 10 / Customer guarantees
The Customer guarantees, assuming all inherent responsibility, and keeping the Seller harmless from any prejudicial consequence, that any and all data provided to the Seller is true and correct and allows to identify the true identity of the Customer.
When registering on the Site, the Customer is given a username (e-mail address) and a password which will be confirmed by the Seller through an email, the joint use of which will allow the Customer to access his / her personal account at any time, will identify the Customer himself and will allow the latter to make purchases of the Products on the Site. The Customer is therefore informed that the Orders submitted through the joint use of a username and password are valid and binding and that the availability of both by third parties would allow the latter to issue regular Orders that bind the Customer, identified by username and password, to accept the receipt of the ordered Products. The Customer is therefore required to keep both the identification code and the passwords with the utmost diligence, keeping both of them secret for the duration of the relationship with the Seller. The Customer is also informed of the need to communicate a valid e-mail address to the Seller in order to allow the Seller to forward the Order Confirmations and any communication.
ARTICLE 11 / INTELLECTUAL PROPERTY
All elements of the www.matissejewels.it website, both visual and audio, trademarks or patents of the respective manufacturers / brands, are protected by copyright. Total or partial reproduction, modification or use of these brands, and more generally that of other intellectual property rights connected to the site, for any reason and on any medium without the explicit prior consent of the Seller's company, are strictly prohibited .
ARTICLE 12 / LAW
These conditions are subject to Italian law. In the event of a dispute, the Seller and the customer will try to resolve it amicably, through the customer service, the details of which are mentioned on the website https://www.matissejewels.it If there is a failure in the transaction, the competent court in the event of a dispute will be that of Arezzo (AR) Italy.
ARTICLE 13 / PRIVACY
Your data will be processed in compliance with the rules set out in the "privacy regulation code" and used only to fulfill current tax and accounting obligations. They will not be passed on to third parties.
